Ice cream recalled in Virginia for failing to identify allergens

Imagine that your child has a severe allergy to some type of food. You went to the store and bought a new flavor of a produfct that you purchase regularly. There was no indication that the product contains allergens, so you allow your child to eat it. Suddenly, however, he or she becomes ill and needs medical treatment. If you found out that the cause was an allergic reaction from the product you purchased, any parent would be rightfully upset.

Today, we expect food companies to state whether their product contains certain types of food products so consumers know whether they are safe to eat. When a company fails to do this, it can result in serious injury or possibly death to someone who unknowingly consumes something they are allergic to.

Virginia residents should be aware of a recent recall of an ice cream produced by Dairy Fresh. The company chose to announce the recall voluntarily after it's Heavenly Hash ice cream was packaged in containers that did not identify possible allergens contained in the ice cream. According to Dairy Fresh, soy, almonds, and coconut may be present in the ice cream.

The ice cream was distributed throughout 10 states, including Virginia. So far, one person has suffered an allergic reaction from the ice cream, according to Dairy Fresh officials.

While we hope that no one in Virginia is injured because of this incident, if anyone is, they should know that they have legal options. When a person becomes injured or ill because a company failed to properly package their product, he or she can choose to hold that company accountable through product liability laws. By filing a product liability lawsuit, a consumer may be able to obtain compensation for their injuries, including any medical bills related to the product in question.
