This blog recently discussed the dangers of truck accidents and their serious impact on victims. A recent fatal truck accident in a Virginia community a couple of hours northeast of the Roanoke area is being investigated by authorities. The truck accident involved a semi truck and passenger vehicle. Investigators reported that a semi truck hauling sand crossed over the center line as it was traveling south and struck a passenger vehicle heading north. The force of the truck accident resulted in the tractor trailer overturning.

The 69-year old driver of the passenger vehicle, and his two passengers, including his 69-year old wife, died at the scene of the accident. The 51-year old driver of the semi truck was charged with reckless driving in the fatal truck accident, and authorities reported that additional charges are pending. In the case of criminal charges a truck driver may face related to a tragic truck accident, a “guilty” finding on those charges and citations may be viewed as evidence of negligence carrying civil liability for the driver or trucking company as well.

A negligent driver may be found liable to truck accident victims, or surviving family members of victims of fatal truck accidents, following a personal injury or wrongful death claim for damages. In circumstances when truck accident victims have been injured, victims may be able to recover compensation for medical expenses, lost wages and pain and suffering damages from the negligent driver. In circumstances when truck accident victims have been killed, their loved ones may be able to recover compensation for medical and funeral expenses, pain and suffering, lost income and other damages.

While the legal resources available to truck accident victims and their families may not erase the suffering associated with the truck accident, they may be able to help with the practical concerns families face during the difficult period following a fatal truck accident. A negligent truck driver may be responsible to victims for the financial and emotional harm of the truck accident they caused, which allows victims and their families to more fully focus on the rebuilding process following a fatal truck accident.
