Understanding the impact of brain injuries on Virginians

The Brain Injury Association of Virginia seeks to help Virginians suffering with devastating brain injuries. Brain injuries can be opened and closed injuries, traumatic or non-traumatic. However, all brain injuries can be serious. Closed head trauma that leads to brain injuries is more common. In general, brain injuries result from head trauma.

Traumatic brain injuries (TBI) can occur in a number of ways, including because of a fall or in a motor vehicle accident, such as a car or truck accident. Bicycle or pedestrian accidents may also result in a TBI. Victims of TBIs may suffer a number of cognitive, emotional and physical symptoms that can affect daily living. It is estimated that 262,000 Virginians live with disabilities associated with TBI or stroke.

The Virginia Department of Health estimates that each year 28,000 Virginians sustain TBIs. Additionally, according to the Virginia Department of Health, TBIs are a contributing factor in 1,400 deaths and approximately 4,000 hospital visits in Virginia each year.

A TBI can result in daily activities becoming a struggle for both victims and their families. As a result, TBIs can be costly to care for, treat and can cause victims to experience time away from work. Victims whose TBI was wrongfully caused, such as by a negligent driver in a motor vehicle accident, may be left with unexpected physical and emotional challenges, as well as unexpected expenses and financial challenges.

Different legal options, depending on the circumstances, are available to help victims of head trauma and TBI recover compensation for the physical, emotional and financial harm created by another party's negligence. It is important for victims of TBI and their families to be familiar with the legal options that may be available to them based on their unique circumstances.
